The 29-year-old has been on trial with the Latics for the last three weeks following a contractual dispute with Cardiff.
It is the second time Paul Jewell has signed Whalley. The Latics boss brought him to Bradford from Crewe in May 2002 in a '600,000 deal during his spell as manager at Valley Parade.
"I know all about Gareth and he brings us added quality and another body to our squad," said Jewell.
"With Mike Flynn and Tony Dinning out on loan and Jason Jarrett out injured we're glad of the extra body.
