GABRIEL Heinze has lost his bid to force Manchester United to sell him to Liverpool.
The Argentina defender had gone to a Premier League panel claiming United had written a letter allowing him to leave if another club offered a fee of £6.8million.
The panel on Tuesday dismissed Heinze’s case and backed United, who maintained they made it clear to the 29-year-old both orally and in writing that he would not be permitted to join one of their title rivals.
It now appears that if Heinze is intent on leaving the club he will have to move abroad.
The Premier League said in a statement: “The hearing concluded that nature and intention of the disputed 13 June 2007 letter, especially when taken in context of verbal discussions and Manchester United FC’s transfer policy, was unambiguous in that it envisages only an international transfer.
“Furthermore the hearing finds the letter constitutes an ’agreement to agree’, and did not create an obligation or binding agreement for the club to transfer the player to any particular club.
Decision
“In other words the letter is evidence of an intention to negotiate, both between the parties and with potential buying clubs, and not evidence of any intention to create legal relations.”
Heinze does have the right to appeal to the Premier League appeals committee, which is made up of an independent, legally-qualified chairman, a member of the Premier League panel and a PFA appointee.
The decision has delighted United, who were represented by both manager Sir Alex Ferguson and chief executive David Gill at the hearing in London.
It leaves the Argentinian defender in an untenable position at the champions having expressed his wish to make a rare move to United's bitter Merseyside rivals.
Only two United players since the Second World War have left Old Trafford for Anfield and the last was in 1964 when Phil Chisnall made the switch.
Ferguson had been adamant that he wouldn't sell Old Trafford's 2005 Player of the Year to Liverpool boss Benitez or any of his Premiership title rivals.
Liverpool had met United's £6.8m valuation that they had paid Paris St Germain in 2004 but the title holders stepped in to refuse the transfer.
At the centre of the dispute was the letter, given to Heinzes agent, Roberto Rodriguez, and signed by Gill. United told Rodriguez that their valuation of the player was £6.8m and that he could negotiate with interested clubs.
No exceptions were named but Gill says Rodriguez was made aware at a subsequent meeting that offers from Liverpool, Chelsea or Arsenal would not be considered.
Heinze hoped to force United to sell him but now his Liverpool dream is in tatters and his relationship with the Old Trafford fans who had worshipped him is sure to be in ruins.
What is your verdict on the decision? Have your say.

What do the Liverpool fans think about a United player coming to them? He must want his head examined!
Agree with the rest - get rid and reinvest.

Who provided Heinze and his advisers with the ammunition to argue a case for a transfer in the first place?
Do we not employ enough lawyers to get a simple letter to an agent correctly and unambiguously worded?
Or is this another example of the same sort of sloppy administration that cant arrange a urine sample at Carrington properly?

I think it says more about Gabby as a person though. As soon as there is a bit of competition for a starting place he wants to up sticks!
furthermore, Rafa may have opened a pandora's box here.
Do we want English football to be like Spanish or Italian where players move between the madrid and Barcelona, AC Milan and Inter. Lets hope the move is blocked to stop things like that becoming common place in England.

I also can't believe some of my fellow reds slagging of some of the citeh players saying they were divers. I think we aren't exempt on that score with Ronaldo. Wish he'd have played yesterday and we would have whooped the bitters. Not saying we're a one man team but you know what i mean. Wish Arnie Sidebottom was still centre half though, he'd have never turned his back like Vidic did.

We reds are a lot more vocal about our highs and lows.
LeythBlue, Leigh..........you just made me fall off my chair..laughing.
It's not Heinze's departure we are worried about but SAF's training regimen which makes good players into great players.
I also admire Sven for his cool and gentlemanly conduct.
He has done a good job at city using the funds available very astutely.
We may not have scored yesterday but even without two of our stars Manu are are an incredible force.
If this sort of refereeing continues maybe we can add Benate and Stylo to our rival's list.
Apostrophe before the s. No mistake

For you to say 'fergie out' after 3 games, 3 games in which we have completely dominated and lost the likes of Rooney, Ronaldo, and been without the much needed Neville, Saha and not to mention the likes of Park, Heinze (traitor that he is, he would have been better than Sly at left back when evra was on the wing), Ole, Foster, an unfit Tevez, Nani, Hargreaves, Ronaldo and Anderson. All in all considering that massive depletion in first team and squad memebers we haven't played bad at all, we just haven't been efficient in front of goal. Can you imagine any other team coping without any of those players mentioned above in their team?! It is absoloutly crazy and shameful that you disgusting fans think like this. If you want Fergie out then he should take all the countless trophies and the current top quality squad (best squad in the country when they all fit) with him to another club. Maybe then you would have a reason to be angry at the club and without a manager that would have won far less than what Fergie has. Someone please tell me of a better manager than Fergie who has done more than what he has in the past 16 or so years encounting? Who else would run our club better? Is there a single manager alive today who is more commited and United through and through than him? Fergie is United.
We are 5 points off our main rivals which considering our results isn't that bad. The football we have been playing has been good but considering the quality players that are to come back things can only get better. It may not happen immediately, all we can do is support our team and hope the edge in front of goal comes back before the rest of our strikers do. I have no doubt we will bounce back and be atleast challenging at the top before too long. But right now I for one will not jump the gun and start blaming people, if you want to go do that then you're better suited to supporting teams like Chel$ki and join their suppoters in thinking that whatever they want they should get whatever the cost. Get real or get a life.

Taggert should be concentrating more on team tactics than wasting time at a panel meeting about a player who wants to leave.
Dont blame Taggart, blame Quiroz. Roy Keane was right, he screwed up at Real Madrid and now he looks like doing the same at Sold Trafford.
