Tevez deal 'deadlocked'

THE Football Association and FIFA are set to be called in to broker a solution to the Carlos Tevez affair.

The Argentina striker's proposed move to Manchester United has been blocked after the Premier League ruled West Ham must receive the vast majority of the £30million-plus fee.

But West Ham are not in a position to handle the transfer because Tevez's economic rights are owned by businessman Kia Joorabchian.

Manchester United have agreed terms with Tevez and Joorabchian and hoped to have everything tied up last week - but the deal has now reached an impasse.

It is understood some of those involved in the negotiations do not believe the Premier League can act as independent arbiter in the case any longer.

And Tevez's representatives are set to request help from the FA and FIFA - the two bodies who oversee transfers at a domestic and international level. It is understood any such move would be endorsed by Manchester United, who are anxious to get a deal finalised.

Deadlock

A source close to the negotiations told PA Sport: "Diplomatic moves are being made. We are in deadlock and we need an independent body to try and sort this mess out.

"The lawyers all agree Manchester United and Joorabchian are within their rights to do a deal - but the Premier League are saying they can't.

"The Premier League seem to have a vested interest now. They are covering their own backs after allowing West Ham to continue playing Tevez last season.

"Their whole argument is built on the premise West Ham tore up Tevez's contract and claimed to control the player.

"But any court in the land will tell you they cannot do that."

The recent Premier League arbitration found West Ham's actions in declaring all ties had been severed "may not have been legally watertight".

Manchester United and Joorabchian are at a loss to understand why the Premier League are blocking Tevez's move when they sanctioned Javier Mascherano's transfer from West Ham to Liverpool in January.

Contracts

Both players were on identical contracts at Upton Park and it is understood United want to sign the same deal for Tevez that Liverpool agreed with Joorabchian for Mascherano.

The Premier League's argument is that Mascherano had left West Ham before the independent commission's inquiry into the duo's initial move to West Ham from South America, which deemed the pair's contracts to be in breach of regulations.

West Ham were fined £5.5million but "satisfied" the Premier League they had terminated the third party agreement in Tevez's contract.

As a result the Premier League allowed Tevez to play in West Ham's last three matches of the season, when he played a key role in the club's successful battle against relegation.

Having accepted Tevez was now controlled by West Ham, the Premier League were compelled to state the club had to conduct the transfer.

To accept Joorabchian retains control of the player would not only be a major climbdown but could result in legal action from Sheffield United, who felt they were unfairly relegated.

Unless FIFA or the FA can help manufacture a breakthrough, the matter would appear to be heading for the courts.

Well Utd have managed - through no fault of their own - to get involved in a deal that is set to drag on and on. At least we'll have one deal to make this summer like all the others. But it will get resolved and Tevez is worth waiting for. We waited a year for Hargreaves and for Ruud after he was crocked. Tevez's deal will be resolved quicker that those.

It seems to me, that the PL and West Ham are in a no win situation and both trying to protect their own backs. The only 'honest' solution would be to accept West Ham never had any rights to Tevez , in which case they should be demoted and Sheff Utd reinstated.

Sunderland have bid 5m for fullback L Baines while Everton are claimed to have offered 3m for Richardson. KR has played and scored for England, and can play full back and winger. Baines can certainly shoot. Discuss!

WH should of thought about what goes around comes around! Javier Mascherano went to the dippers so whats the crack ? As for the FA i thought FA stood for something else and FIFA well thier just as bad !

We are obviously well within our rights to negotiate with Jorabchian. I could see this outcome coming a mile away, back when the Premier League said West Ham had torn up their contract with MSI. I mean how ridiculous was that!!! "Ah yeah, just tear up the contract lads and it will be grand. I know Tevez and Mascherano are worth about 50m but sure if you rip up the contract there'll be no bother". Simple as that.

This is a quagmire now foe the Premier League and i'm delighted for them. Scudamore was extremely smug and self righeous at the time, and the reason given for not deducting points, that West Ham had a lot of fans who woul dbe disappointed, was pathetic. Tell that to the Shef Utd fans who's team would have stayed up had Tevez not played in the final 3 league games.

The ripping up on the contracts "wasnt entirely watertight"!!! I dont think any of this will stop us from signing Tevez, and as such i'm going to enjoy watching the Premier League squirm over there embarassing decision to pander to West Ham and try to cover their own backs

If this goes to court, it wont last long and will be over in a jiffy! West Ham should be relegated and the PL should just accept that they have made one huge mess of it all!

This is getting crazy.....to say that they own the player is ridiculous....where is their reciept for the transfer money they gave to MSI for tevez...ooops forgot they didn't pay anything only covering his wages during this loan spell, oh and forgot MSI are soooo kind that they agreed for Tevez, a 23 year old world star, to sign for WHU for nothing so that WHU can benefit from any transfer money ....thereby selling a loan player who doesn't belong to them. Bloody farcical if you ask me, and don't you just love the legal brains phrasing 'any lawyer knows you can't do that" referring to WHU brazenly, or so they say, tearing up the this so called thrid party agreement!
At least its as funny these two trying to squirm out it!

WHU have played some attractive football down the years and I respect them for that,but I "think" justice would be done if they got relegated.
Everyone was astonished when Mascherano and Tevez signed for the Hammers.Since of course WHU have been fined for playing an illegal player.Liverpool;have they signed an illegal player?Somebody in the FA seems to have West Ham's interests at heart and not the interest of fair play.An independant body needs to make the registration of these players clean and clear.Why don't they pay back £5.5mil to West Ham and relegate them by docking them the points.(Then just for the enjoyment of UNITED fans,dock Liverpool enough points to push them out of the Champions league spot!)

Quite a game of brinksmanship being played by the Premier League and WHU when all common sense and evidence to date points to them being in the wrong. They are clearly trying to cover themselves in some way. I'm no expert on legal matters but I really don't think they can afford having this thing go to court because MSI appear to have them over a barrel. If it all comes out then Sheff Utd are going to have a field day and look to sue. I also imagine that the Premier League won't want FIFA getting heavily involved through fear of potential repercussions. So in summary, I could still see this one being settled quickly and quietly in our favour following extensive negotiations between all parties.

This is a PR & spin exercise in basic back-covering!!
In one way i hope that it does go to court because then SUFC can sue them..... Unfortunnaetly i think their pathetic behaviour is likely to see us miss out on a settling a great signing quickly for the new season.
Bobbydazzler- you're probably right but even better was Parrys comments about loans, thinly veiled at our selves when they've loaned Mascherano!!!!!
This is their own fault because their decisions are biased and didnt hold up their own rules....

If there is any justice in the world WHU should now go down. It looks increasingly dire for WHU and they will blame ManU for it as they almost got away with it.

And the PL surely need to take a hard look at themselves after all this.

They always want to make ManU an example almost every season yet they are so scared of Chelsea. They have always tried to punish us, season after season.

I still think Tevez will be signed up before the season begins. Besides I cannot see him play for WHU. I have a suspicion that the PL were not expecting a premiership side ManU in particular to go for Tevez. They would rather he signed for a club outside of the premiership (Madrid/Inter).

United wanting to sign Tevez is a nightmare for both the PL/WHU partnership.

So here we go again. The Premier League, The FA, FIFA. Layer upon layer of beaurocratic incompetence.

Consider this for a moment: what do these bodies actually do? Other than set playing rules and pay for a nice trophy, what do they actually do?

The way I see it, all games are played by CLUB owned players. Hmmm. That seems then that the "official" bodies are making lots of money on the back of massive investment by clubs. It is exactly the same as me taking your Ferrari one week a month, using it to make money and then returning it empty and dented with not so much as a thank you. These bodies spend so much time enforcing their power and authority because they are scared that, in reality, they have no power whatsoever. It is time the G14 (G18?) clubs made the step of parting ways with these fools. It would be plausible to create a truely independant not-for-profit governing body, and then invite all the other clubs to join the new leagues. Still, I would miss Sebb Blatter's inane comments such as "women should play footie in hot pants." Actually, come to think of it, ignore everything I just said!

What "just tear up a legal contract sure no-one will do anything" The PL couldn't manage a runny nose. What are they hiding? Liverpool got Mascherano on exactly the same deal, so why now after they saved a team that should have been punished harder for what happened and at least had a point deduction for the start of this season, now would Utd, Liverpool or Blackburn got away with acting in this manner? I think not. Is this some cynical ploy to get as many London clubs in the PL before the olympics, at the cost of the rest of the league? who knows but then again the PL ceased to be impartial years ago. Hurry up FIFA settle this once and for all.

Mascherano should be sent back to Upton Park until this is sorted. Then West Ham should be relegated. Then Sheff Utd reinstated. Then Scudamore should resign, as everybody knows West Ham never owned either player. Then somebody should take this wedge off us and let us start training our new striker. This is disgusting and corrupt

This whole situation was driving me to despair last night but I'm feeling a bit more confident this morning (football, eh? bloody hell...)

There's a good piece on one of the West Ham fan-sites explaining how this can be resolved to everyone's satisfaction.

United MUST pay all monies for Tevez directly to West Ham, the player moves to Old Trafford with WHU transferring his registration to his new club in return for a transfer or loan fee. No fee is paid to MSI, except for a standard 20% agents fee.

At this point both Man Utd and Hammers have fulfilled their obligations to the League officials, the player moves clubs and the whole deal is rubber stamped.

THEN, his agent gives notice to West Ham that he is taking the club to court for unpaid 'rights' payments and/or breach of contract. The next stage is that legal representatives of Joorabchain and Mr Magnusson sit down and negotiate terms for an 'out of court settlement'. At this point the matter is sub judice and the press will have to keep their beaks out.

Hey presto: Tevez gets his move, MSI get their cash, West Ham wash their hands of the whole affair and the Premier League appear justified in their decision to allow Tevez to finish the season playing for West Ham.

P.S. Off course, the above solution is horribly under-hand and grossly unfair to Sheffield United but it was the Premier league that shot them in the back, not MUFC.

Good point, Bobbydazzler! Something stinks in all this and most of the smell is coming from the Premier League and West Ham. Also, funny, how often the Scousers get things their own way - CL entry despite finishing fifth, signing Mascherano - while Utd always have to fight through no fault of their own. Brian Barwick - what a laugh! This is the guy who was main execitive in the process which led to the appointment of Steve Mclaren. Heard the Americanism - 'The guy can't walk and chew gum at the same time.' There is a ruder version but it means the same thing.

The PL are desperately trying to protect their position because if WH are not seen to receive money from the transfer, it will prove that the third-party agreement between them and Joorabchian for Tévez was not ripped up.WH were required to terminate that agreement after being found guilty of breaching league rules in his transfer. That would then provide SU, who were relegated in WH¿s place, with fresh ammunition to pursue their case against the PL clowns for not establishing whether the agreement was terminated. Wonder how Bellamy will enjoy playing in the Championship!

If this deal go through it will open a can of worms that will spiral out of control.After one season Tevez's agent could pull the same stunt on United by accepting financial inducements from other clubs which is what United are doing now!

Either Bellamy has been given assurances WH will be in the Premier league or he has a clause to void the transfer I imagine. As for Sheff Utd you can sympathise but at the end of the day they played poorly all season and on the last day they had destiny in their own hands - and failed. Do you think had e.g Roy Keane been in that side they would have given up to a newly resurgent Tevez-inspired WH comeback? No. So I can sympathise but in a way they are trying a backward route back in rather than just the poor defenceless victims. As a fan would you want to see your team heroically in the league because of a court-case after a failed season or a last minute volley into the top corner? It is all about the money and you cannot blame a poor little club like that trying. I bet a pay off from Magnusson to them that allowed them to finance a few transfers to go for promotion again would see them appeased enough. As for the whole thing well we all know the Pr League will not back down as it would show incompetence. Let's hope a solution can be found. Now we cannot do anything so to quote a Homer Simpson solution personally "I'm planning to hide under a pile of coats and hope that everything works out fine"

KingPig, whatever about the incompetence of the Premier League or FIFA, believe me you do not want the G14 running amok with a free reign. That would be rampant capitalisism and the fans and grass roots football would be the worse off long term. The G14 are interested only in themselves and their money. Whilst the current setup is far from perfect, there is at least some token effort made towards redistribution of wealth and equal treatment and enforcement of rules. Obviously as this Tevez case proves, the system is not a good one, but i shudder to think how it would be if the fat cats of the G14, including us, were allowed to make the rules
