Ian Brady wants to transfer to a prison in Scotland
MOORS murderer Ian Brady is to apply for transfer to a Scottish prison so he can die in his homeland, his lawyer said.

The notorious child killer, who was born in Glasgow, is being force-fed after a series of hunger strikes.

Lawyer Giovanni Di Stefano said the move was inspired by the release of the Lockerbie bomber Abdelbaset Ali Mohmed Al Megrahi on compassionate grounds.

Brady, 71, and Myra Hindley were jailed in 1966 for murdering five children in Greater Manchester during the 1960s.

Mr Di Stefano told a newspaper: "There is no reason Brady should not return to his own country just like Mr Al Megrahi did.

"The attitude regarding mental health in Scotland is perhaps somewhat diverse to the UK, and I have told Brady that he may well achieve his goal by being transferred there."

The Italian lawyer hopes to have Brady moved under the Repatriation of Prisoners Act 1984 and is preparing an application for transfer to Carstairs in Lanarkshire, Scotland's only high-security hospital.

Stunt

But authorities on both sides of the border have dismissed the move as a 'publicity stunt' and said any application would almost certainly be rejected.

Brady is currently being held in Ashworth High Security Hospital, Merseyside. He has been on hunger strike since 1999, with medics force feeding him through a tube.

Mr Di Stefano, who has previously acted for Saddam Hussein and notorious Serb leader Slobodan Milosevic, suggested Scottish authorities would be more likely to allow Brady to die.

He said: "All Brady wants is to be moved to a prison and be allowed to die. We would look to have Brady moved to Carstairs Hospital or a similar unit. We are then confident he would be declared fit enough to be moved to a mainstream prison. Once there, he could then take the decision whether he wanted to eat or not.

"Brady is evil, without a doubt. He doesn't want out - he simply wants to be left to die. We believe Scotland offers the best opportunity for him."

The child killer previously launched a legal bid to stop medics force feeding him, rejected by the High Court in 2000. His lawyer claimed as much £1m was being spent each year on continuing legal fees and healthcare.

The Department of Health, which is responsible for Brady's treatment and would need to approve the transfer, said it had not yet received any request.

However, the Scottish Government said they would oppose any attempt to move the child killer across the border.

A spokesman for the devolved government's justice department said: "Any application would have to be made to the relevant prison authorities in England and we are not aware of any such request. "It is not something we would support."

I think the precedent has been set by this government in allowing somebody who killed 270 people to be transferred home. As long as he is still in jail and not realeased then that's OK.

That said Scotland doesn't seem to review the ramifications of release, just whether they are legally allowed to. Maybe it is better that he serves his time in England as they Scots may well release him.

Mike is spot on - Brady is a calculating child killer. He has seen that the mass murder got released on compassionate ground and now Brady is trying his luck. Brady should die in prison end of line.

how much is this lawyer charging 1m a year on legal and health, well health is included in the prison budget because he is being kept in a secure hospital. So this lawyer is charging the state a million a year for few letters a couple of phone calls and a number of visits.As for Hindley he can rot in hell, I also note that Ronnie Biggs is still alive and kicking despite being released because he only had a few days left.
The Lybian i am not sure about as I have listened to the English relatives of the victims and they unlike their American counterparts believed that he was framed by American intelligence to comply with their stance on Lybia and maintain relations with the country really responsible.

Why is this evil man locked up in a secure mental unit - he obviously knows what's going on to request this ? Or has he got some apologist doing it for him ?

if you just knew what money he has been paid in jail/mentle hospitals etc. he could buy a luxury hotel- personally he should stay in a very small cell six feet under.i think the public should know what allowences people receive in JAIL ETC

Brady - or Stewart as he was then called left Glasgow in 1954 - to live with his natural mother who had moved to Manchester.
He made a choice to live in England - having a foster parent in Glasgow by the name Sloane.

He cannot expect to be allowed to die in Scotland whilst he refuses to reveal where Keith Bennett is and allow a young boy to be laid to rest properly
