A YOUNG mum has been ordered to pay nearly £400 - for leaving her wheelie bin in the wrong place.
Holly Dutton, 26, of Grace Street, Horwich, failed to pay a £100 fixed penalty notice issued for leaving the bin in the alleyway behind her house in July.
She has been now been fined £130 and ordered to pay £215 costs, plus a £15 surcharge towards a fund for victims of crime, after the case was heard by Bolton magistrates.
Council bosses claim people who do not bring their bins into their back yards between collection times attract arsonists, and the prosecution is the first in a crackdown across Horwich.
Stunned
Miss Dutton, who has two young boys, said she was stunned by the prosecution.
The agency carer admitted being fined £100 by a council worker who called at her home in August.
But she says she appealed against the fine at Horwich Town Hall days later - and only learned the matter had got to court last night when approached by the M.E.N.
Miss Dutton, who shares the terraced property with her partner, accounts clerk Chris Heaton, 26, said: "This has come out of the blue. It looks to us like a council money-making scheme that deliberately targets poorer families in smaller properties."
Bolton council issued the fine in August, saying Miss Dutton ignored a warning of the `legal requirement to bring a wheelie bin back within the boundary of a property between collections'.
Miss Dutton said: "The only warning we ever got was about recycling.
"We had kept the bin in the ginnel for seven years because the yard is only 8ft by 4ft and if you keep rubbish there it starts to stink."
Bolton council said that Under the Environmental Protection Act 1990, it is an offence to leave a bin outside a property between collections. Householders face a fixed penalty fine of £100 or prosecution if they fail to pay up. Fines are reduced to £75 if paid within 10 days.
Council spokeswoman Elaine Sherrington said: "We don't take the decision to prosecute lightly. This case shows that ignoring our advice and failing to act on a fixed penalty notice could be pursued through the courts."

If this was was a point of principle - fine. I'd tell this woman to stand up for what she believes... but in reality, it was just that neither she, nor her family, could be bothered to take a bin in.
Stop whining and pay the fine.

It's like that mother and daughter a few weeks ago who were fined for dropping litter in Albert Square. They were angry as they weren't given chance to pick the litter up and put it in a bin and complained that there weren't any signs around warning that they could be fined for dropping litter. Don't drop it - easy.
Put your bin where it should be - easy.

The council have chosen her as an exmple and once again victimised someone who will find it difficult to fight back.
As for the comments by all the smug people who agree with this fine, knowing only the basic circumstances, then all I can say is it must be nice to be so perfect and never forget to do a single thing.

Seems councils are cracking down yes where i live the council have introduced 3 different coloured bins 1 for general waste one for garden waste and now a recycle bin with no mention of when to put the garden waste one out, if i do it wrong will i be fined??
all this and no such reduction on the council tax !!!!!!!!!!!!!!!!!

At the end of the day this is the council picking on the little people once again, no doubt those who posted on here supporting them are sat at home in their big houses putting the worlds to right, when in fact they dont know the first thing of how the world works.
Can i also just say thanks to the messages of support and to those who agree with the council, best see where jeeves is with afternoon tea!!

To those who agree with this I jsut assume that you either work for the council or so far up your own a*se that you dont know what happens in the real world and believe everything you read.
Our bin is taking in every monday afternoon/night and we are not constant offenders of leaving our bin out. In the 7 years we have lived on the street we have never seen or heard of any bins being set on fire in the back streets.
I would also like to thank you for the comments of support and also a massive thanks to Chris (the reporter) who brought this matter to our attention as we havent even received a summons from the wonderful bolton council!
