A PUBLICAN says he broke the national smoking ban on the day it came into effect - by smoking in his own pub.
But John Barrett, 47, owner of the Brown Cow, in Heywood, believes council officers can't stop him doing it again because the pub is his home.
The former paratrooper and dad-of-three, who claims he had three cigarettes behind the bar when it was quiet, said his takings were down by £300 on Sunday, He warns that if there isn't an upturn, he will be forced out of business.
He said: "Unless they make it illegal altogether, I'm not going to stop smoking in my own home.
"If the officers want me to stop, they'll have to catch me. On Sunday, we had to send all our staff home because there was nothing to do, so I had a smoke - it's part of my human rights."
He added: "I am considerate and never smoke in restaurants. I always go outside. But in a pub, people should have a choice."
Adrian Watson, from Rochdale Council, said: "Mr Barrett has confirmed he isn't allowing the public to smoke in his premises."

These "rebels" need their licenses suspended until they agree to abide by the law and then further breaches resulting in them losing their licence altogether.

So where do we go from here ? How can it be legal to buy cigarettes but illegal to smoke them. When will the "thought police" be knocking on my door to arrest me for thinking about having a fag ?

This is a desease that not a lot of smokers know about "Me included"Until a few years ago.Since a found out the hard way,i now know the real dangers of smoking and passive smoking."For those who say passive smoking has not been proved to cause damage" As usual youve all got it wrong smoking has been proved beyond all reasonable doubt causes lung deseases.So those landlords who allow people to smoke should remember that technically you can now be sued "in law" for causing damage to a person by allowing smoking on a licenced premises?.Knowing that its illegal and against the safety at work laws now....Keep smoking at your own risk but dont impose it on others....

I belong to a radio club ?but ive not been able to attend the meetings because of the smoke? now that smoking is ban in all public places it now frees me to attend .its not just pubs its all places that the public attends. so if this includes pubs "they should come into line" People like you are so self centred .Think of other people who dont want to breath this toxic smoke (that has been proved to cause all sorts of health related problems)passive and smoking alike . THERE IS NO ARGUMENT YOU WILL HAVE TO COME TO TERMS WITH NO SMOKING IN PUBLIC PLACES (TOUGH LUCK IF YOU DONT LIKE IT).

No doubt you would like to see smoking and non smoking shops? cabs,buses,clubs,You cannot start making single use services for everybody.it makes sence to ban smoking in all public places including pubs ect. because smoking is becomming unacceptable to modern thinking people. if you want to smoke nobody is stopping you but do it safely in your own space. dont include others in your filthy habit.PLEASE...

Experts are putting pressure on the Government to introduce a "fat tax" on unhealthy foods, saying it could save thousands of lives a year.
I hope all you obese non-smokers are looking forward to your punishment. It's about time that the cost of peoples greediness to the NHS was recognised.

My suggestion to you all is to wake up and see what is really going on here, because it won�t stop at a smoking ban. If elected governments are given cart'e blanche to do what they weren�t elected to do, they will do anything they damn well like, (remember Thatcher and her poll tax/community charge). And finally let�s face it if we all have to feel so safe in life that we forget to live, it is no life at all.
