TORY MPs Ann and Nick Winterton have accused Commons sleazebusters of unfair treatment after they were found guilty of breaking expenses rules.
A Commons standards committee found they breached rules by claiming £165,000 allowances for rent on a £700,000 second home in London, which they owned, avoiding death duties.
Using a loophole in Commons rules, they claimed more than £30,000 a year in expenses from the taxpayer after transferring the Westminster property to a family trust set up for their children in 2002 and then rented it back.
The committee said the Cheshire couple inadvertently broke rules tightened up in 2003.
But Lady Winterton, MP for Congleton, said they had not been treated fairly.
She said: "We believe the tenor of the report places the onus disproportionately on us. We are perfectly agreeable to share the responsibility but feel that we have not received fair treatment in this regard."
Sleaze watchdogs agreed with Standards Commissioner John Lyon that they had been in breach of the rules since July 2006. MPs said they knew about the breach in February last year and should have addressed the issue earlier.
But Lady Winterton hit back, quoting from Commons officials who accepted that because of an administrative error, a ruling was not sent to them.
The committee, who have the power to recommend sanctions against MPs who break the rules say that Lady Winterton and Sir Nicholas, the MP for Macclesfield, had at no stage attempted to conceal the arrangements.
But the MPs committee say that from September this year the Wintertons should no longer claim expenses for rent on a property they own.
Labour prospective candidate for Congleton Gary Poole, who was one of two people to claim that Commons rules had been broken, said his complaint had been vindicated.
"At a time when hardworking families are facing up to the global problem of rising living costs, they see their MPs letting them down," said Mr Poole.

They have done nowt that all other MP's are and have been doing. As expenses claimers they are not in the top 500 of the M.P.'s.
I don't agree with what they did, but they are no worse than 635 others.

Additionally to claim they didnt realise is really pathetic. 2 highly educated MP's who are no doubt have access to first class accountants/lawyers etc didnt realise they were breaking the rules. Do me a favour. And even if they didnt, since when was ignorance a defence?
They are both a total disgrace, an embarrassment to their party and a discredit to their profession. If this squalid affair doesnt eat into his majority in Macclesfield then nothing will.

Let’s apply a little reason. Almost very MP needs two homes: one in the constituency, where we demand their presence at weekends; the other near Westminster, where we demand they work all week. When our employer tells us to spend a night away then we expect him to pay our expenses so surely MPs deserve the same? Dear reader, when you last spent a night away did you tell your boss, “No expenses, you already pay me far too much.”
The Wintertons have claimed market-level expenses for their essential London base. We’re angry because they or their family received that same money instead of paying it on to someone else. But that is because they bought the flat fair and square with their own money. They were entitled to a market-level return on their investment. Dear reader, when you put your money in the bank do you say, “Don’t pay me interest, give it to charity. I already have far too much”?
Yes it does look awful. If only they had got themselves a proper spin doctor like Alistair Campbell. He would never have allowed it. “Money to invest? Buy another flat and keep yours mortgaged. Then the finances will be the same and no one will ever know. Your money is your business and only your expenses are their business”. Easy. What a shame they didn’t do that.
Sir Nick works hard for us. Anyone who has written to him will tell you that. They have been naïve and they failed to jump when the rules changed but Sir Nick, in my experience, has a good honest heart. Yes they are both Tories. Sorry about that. If it annoys you then admit it, that’s really what it’s all about isn’t it?

I do not see what they have done is wrong. How can it be right for an MP to claim expenses to pay for a flat that belongs to a stranger but not calim expenses for a flat they rent from a trust in which they are trustees? At the end of the day even if the Wintertons hadn't claimed expenses for this flat they would have done for another belonging to a landlord. They originally bought the flat out right, and quite rightly deserve to claim expenses for their second London home - whether that home belongs to a stranger or themselves they are still entitled to it!
The Wintertons are not evil right wing out of touch loonies the press like to portray them as, they are hard working and decent. They commute EVERY week to their retrospective constituencies, and attend the house regularly - which is more that one can say about many other MPs... Yes they may have a few opinions that seem old fashioned, but we live in a democracy and their voice deserves to be heard. They also have some sound opinions.
This has all been whipped up by the media to try and find another juicy story to sell a few rags. I hope the people of Congleton and Macclesfield are a little more switched and back their MPs, who have backed their constituencies tirelessly over the years.
Give them a rest please Macclesfield Express...
As for the sheer cheek of the Labour PCC to comment on families under hardship etc at present - it's the fault of years of miss management by his party (Labour) that has fuelled the hardship...

As for suggesting poor Old Nick was naive then get a grip. If that is the case his accountant should be sacked for incompetence. He was caught, no question, and i am sick of people like you bleating there are worse offenders? Is that really a defence for an MP?
